Definition and Nature

DPSP: Constitutional guidelines that direct the state to implement policies achieving social, economic, and political justice for all citizens.

Legal Nature:

  • Non-enforceable: Cannot be directly enforced in courts
  • Guiding Principles: Guide state's legislative and executive action
  • Constitutional Directive: Not legally binding but constitutionally important
  • Aspirational: Reflect long-term goals for society
  • Non-justiciable: Court cannot say "you must implement DPSP by this date"

Key Phrase: "The State shall endeavor to..."

Historical Context

Why DPSP?

Problem: After Independence, India was very poor

  • Needed state intervention in economy
  • Private sector alone could not solve poverty
  • State needed to be actively involved in development

Vision: Constitution wanted state to work toward:

  • Economic justice
  • Social welfare
  • Equitable development
  • Protection of vulnerable groups

Inspiration

Irish Constitution: First constitution with DPSP

  • India adopted similar concept
  • Believed constitution should guide long-term policy
  • Not just protect individual rights but promote welfare

Gandhian Thought: Gandhi emphasized:

  • Trusteeship (state as trustee of resources)
  • Sarvodaya (welfare of all)
  • Economic justice
  • Protection of poor

Philosophy Behind DPSP

Rights vs. DPSP

Fundamental Rights:

  • Protect individual from state
  • Immediate: must be protected now
  • Enforceable: courts can compel state
  • Defensive: protect existing freedoms

DPSP:

  • Direct state action for social welfare
  • Gradual: to be achieved over time
  • Non-enforceable: courts cannot compel
  • Positive: state must provide/create

Integration of Both

Constitution aims for BOTH:

  • Protect individual freedoms (rights)
  • Promote social welfare (DPSP)

Relationship:

  • Rights are floor: minimum protection
  • DPSP are ceiling: aspirations to reach
  • Both serve social justice objective of Preamble
